1. Booking & Payment
A non-refundable booking fee is required to secure your requested date.
No date will be confirmed until the booking fee has been received.
The booking fee will be deducted from the total package price.
The remaining balance must be paid as agreed prior to final delivery of content.
2. Cancellations & Rescheduling
Cancellation by Client
If the client cancels the booking at any time, the booking fee will be forfeited.
Rescheduling by Client
Rescheduling requests must be made at least 14 days prior to the scheduled shoot date and will be subject to availability.
If a rescheduling request is made less than 14 days before the scheduled shoot date, the booking fee will be forfeited and a new booking fee will be required to secure a new date.
Only one reschedule is permitted per booking unless otherwise agreed in writing.
3. Delivery Timeframes
Photography: Final edited images will be delivered within 14 working days after the shoot date, unless otherwise agreed in writing.
Videography: Final edited videos will be delivered within 25 working days after the shoot date. Complex projects may require additional editing time, which will be communicated where applicable.
Delivery timelines commence once the shoot has been completed and all outstanding payments have been received.
4. Photographer / Videographer Cancellation
In the unlikely event that Black Media Visuals must cancel due to illness, emergency, or circumstances beyond reasonable control, every effort will be made to arrange a suitable replacement.
If a replacement cannot be secured, a full refund of all payments made will be issued. Black Media Visuals shall not be held liable for any additional costs or damages beyond the amount paid.
5. Location, Permits & Permissions
The client is responsible for obtaining all necessary location permissions, permits, and approvals for the shoot.
Any location fees are the responsibility of the client.
Black Media Visuals will not be liable for fines, penalties, or disruptions due to failure to secure proper authorization.
6. Client Responsibilities
The client agrees to provide accurate information regarding the shoot requirements.
The client must ensure timely arrival and cooperation during the session.
Delays caused by the client may result in reduced shooting time without refund or extension.
Black Media Visuals is not responsible for compromised coverage due to interference from guests, venue restrictions, or environmental factors.
7. Creative Control
Black Media Visuals retains full creative control over the shoot, editing style, composition, and final delivery. While client input is welcomed, final artistic decisions remain at the discretion of the photographer/videographer.
8. Copyright & Usage
Black Media Visuals retains copyright ownership of all images and videos created.
Clients are granted a non-transferable license for personal use or agreed commercial use.
Content may not be altered, edited, resold, or used for profit without written consent unless otherwise agreed.
Black Media Visuals reserves the right to use images and videos for portfolio, marketing, social media, and promotional purposes unless otherwise requested in writing prior to the shoot.
9. Data Protection & Privacy
All personal information collected during bookings, consultations, or communication will be treated as confidential. Black Media Visuals will not sell, share, or distribute client personal data to third parties, except where required by law.
10. Limitation of Liability
Black Media Visuals shall not be held liable for circumstances beyond its control, including but not limited to weather conditions, equipment malfunction (where reasonable backup measures are in place), venue restrictions, acts of God, or other unforeseen events.
